Blizz has left private servers/emulators alone unless they are making money out of it. These generally happen to be the bigger ones as they need a decent income to pay for bandwidth and rack space.

My concern regarding Diablo emulation is how it will change your game client. Blizzard have already banned sc2 players accounts because they modded their game for single player.
There are many reasons, here are 3 good ones
Reason 1:
Blizzard makes rock solid, long supported games. Why just LAST WEEK, a patch for Diablo 2 was released - 1.13d. Blizzard are so awesome, they patch games 10 years on, fixing bugs and tweaking the game. If Diablo 2 is anything to go by, then re-cracking and re-configuring your cracked version of Diablo 3 10 years later is gonna be a tricky and annoying task. Why go through the hassle?
Reason 2:
A cracked version of the game = no auction house. You can't make real life $$$ from the loot you find and you can't buy awesome loot.
Reason 3:
A cracked version of Diablo 3 is going to be a lonely solitary experience when it shouldn't. No proper friends list, leaderboards, achievements or option to compare stats and achievements with friends is gonna suck. Anyone who has played Diablo 1 or 2 knows deep down that is would've been such a damn awesome feature to have in the original titles. It's now in Diablo 3 and you're gonna squander it by not having access to it just because you think a cracked copy of Diablo 3 is a good idea.
That's just my 2cents. Use it dont use it. If you've decided to pirate Diablo 3, I'm probably not going to be able to change your mind. But hopefully those 3 reasons above will help you see the light.

You bring out excellent points but not everyone wants to pay for the game despite how awesome it is,
Some people also don't support blizzard, and finally Some people just want a quick game (with or without lan) without the hassle of using internet.
Don't get me wrong here, I totally support blizzard and think anyone who loves gaming and does not buy the game is shooting themselves in the foot.
But alas there will be people who pirate it.
Please don't confuse emulation and piracy. Wanting to play a game you bought in offline mode is not the same add pirating.

This isn't something that doesn't appeal to me. I don't see myself ever using a system like this.
Once again, features that aren't important to me. And if you look at my original post, you'd notice I said I'll buy the game before playing a pirated version. From this week I'll be gaming on a laptop and I won't always have internet connectivity. It would suck not being able to play because of that.
Why? Interesting remark. I mean sure the co-op and online stuffs are kewl, but I played D2 on my own about 20 times and loved it everytime. I mean I'm not saying pirate it, but I'm really hoping that there isnt too much lag on the online play...otherwise I may just have to grab this LAN patch so that I can enjoy it with my mates.

some benchmarks I found for the diablo 3 beta. I thought this was the right thread to post this in because one of the only reasons I can think of getting a pirated/sandbox version of the game is to check if your machine can run it.
Edit: granted they only tested out on laptops, but its still interesting I suppose for many.

What this emulator is doing is, its basically allowing you to run the client without needing connection to the server. However, since the client isn't getting data, there are no mobs and no loot etc etc. All that logic sits on the blizzard servers, which means that you still wont be able to play the game (and I quote from the creator) "Please note: This is a sandbox meaning there will be no real content but an ability to look around places and view the game mechanics".
Now, granted some clever guys will probably figure out what data is required for Diablo 3 to show monsters and loot, but ultimately it will probably not be anywhere near the quality of the real-deal. Wow emu server took years before it got close, but they are still riddled with bugs. It kind of like the difference of getting a unqualified plumber on the side of the road to fix your leaks vs getting a qualified one.
