It depends how you write the backup. You need to use something like alcohol 120% or daemon tools or any dvd to create a matching image. You can them write this image to disc and have a backup. This is legal provided you have the original copy of the game.

Some games specifically allow mods. It really depends what the license says. Also with a mod you aren't trying to reverse engineer anything so are generally just adding to the game while with a crack you are bypassing some of the mechanics of the game.
