    is this legal? Do you have the rights to use licensed trademarks?

    The essential elements of an infringement of a trade mark under section 34(1)(c)

    Granted points (a) to (c) are met but how is the shirt unfair or detrimental to the Portal logo? It's not like he is using the logo to promote his own game (unless you can confuse a t shirt with a game) or such but rather to associate gamers with a brand that they are passionate about. Then the logo also isn't being used to damage the Portal game franchise either so in my mind the shirt is fair game.

    Is isn't. In fact, he promoting it. But on the other hand, he will essentially be making money off someone else's trademark.

    Don't get me wrong, I love his Tee ideas. If I could afford it, I would buy it. But Stunt does raise some valid points.

    He is being paid to do so. Even if it's at a loss, he is being paid to sell the copyrighted intellectual property of a registered company. You guys aren't buying his t-shirt because you want t-shirts, the appeal is the illegality in question, the Portal Trademark.

    True but as has been proven in previous court cases, use of a trademark on a shirt is not enough to prove infringement, instead you have to see the whole picture of how this impacts on steam and portal and can they prove dilution of the brand as well. Generally consumers are allowed freedom of expression and in this age brands are seen as a form of expression and as such people are allowed to associate themselves with a brand provided their expression does not negatively impact on the original brand.

    Therefore while stunt does have a point, it is also unlikely that these shirts would ever be deemed to be an infringement on portal and steams rights in their current form.

    Stunt is right.
    I never disputed the validity of Stunt's claim... cos there are no grounds for dispute.
    Copyright is what it is... They own the design and I used it without asking.
    I've asked now... Maybe they'll be ok with it. If not, that's gonna be really sad.

    Then I'll print it just to spite them.
