He won't win. I doubt this will make it past one court hearing.

Yeah, note the words "class-action". If it gets approved as a class-action lawsuit there's going to be a crapton of potential money for the lawyers and you can bet that there'll be a handful of well-paid attorneys willing to argue the case in court.
I used to be conceited, but now I'm absolutely perfect.

Nah bra, if I lived in the US I would probably do it as well. There's money to be made out of that lawsuit

    He could win:

    1. Advertising their peer to peer system as an improvement over dedicated servers, a technical and physical impossibility, ie. lying/false advertising.
    2. Kotick stated publicly that the PC version would "remain as it always has", purposefully creating a false belief that dedicated servers would remain intact, when infact they have been axed. ie. lying/false advertising.

Kotick will claim when he said that it was true and it was only changed later.

haha thats random, although if it actually goes to court, maybe IW will start realising how serious people are about the new changes and do something about it.

Well, from what I picked up, the prosecution could just argue that the fact it was worse is actually someone's opnion, and that MW2 thought it was better, so they were right in that regard. Also they would argue that Xbox gamers have been using this type of service for ages, and have had few complaints, and that they were also giving ordinary people a chance to play.

And, don't knock it till you try it, correct?

Actually, a similar thing happens here in SA over advertising. They evaluate the common persons understanding on what the advert would mean.

Also, it's hard to argue over the expectations of a product that isn't released yet?
    Wait... what?
