Without a doubt Beo you are correct. It has been posted on the forums before as well, but for the money the 970 is unbeatable. The problem with the card is not the "3.5GB VRAM", it is the fact that Nvidia hid it and the false advertising.

The fact that they lied does not detract from the card's performance. The benchmarks that were run are a true reflection of the cards power and no one can dispute that. It's not like the benchmark programs went: "Oh look, it says 4GB RAM on the box, thus the performance should be great". They test with what the card physically has.

If you're gaming at 1080p this is the best card for the money.
