These has come on the back of a forced arbitration ruling in the states which doesn't specifically apply to this type of situation so I think EA and Sony are just trying their luck to see if it will hold up when challenged.

You can't stop someone from suing you, you can only try and limit the exposure. Even those indemnity forms places have you sign saying they take no responsibility for what happens, we'll guess what they are STILL responsible. So the form might stop you from suing them if you got motion sickness from a bungee jump but it won't help them if you got injured and you can prove negligence in their part.

Well this specifically says that you can sue them in your personal capacity but not as part of a group. But like I said I'm not a legal person so don't know.

All they need to do is buy themselves a few politicians to pass a suitable law, particularly in the US.

That's exactly what this is all about. Also: If they change their mind and sell all your details you can't sue them for breach of contract - even though they promised they would never sell the details, you now have no recourse.

It is not unconstitutional. You have no "right to sue" by the constitution in any country on Earth. This clause in the agreement does and will hold. If, like mentioned above, EA sells everybody's personal info - there can't be a class action lawsuit. Nothing. You're f***ked. Go sit down and cry in the corner.
That kind of thing should carry the death penalty for the entire executive team.

Lol, stuff getting them shot. That's too quick and humane. I say use ancient Chinese torture techniques. Hell, even Medieval techniques would suffice to induce large amounts pain, slowly killing them off.

Or castration by plastic spoon would suffice as well.

But yeah. As has been mentioned, if you can prove gross negligence on their side, then that little agreement counts for nothing, nada, zip, zero. Where there is a clause, there is a loophole.

It's not about having done so before, but keeping the door open to do so in the future. If a class action lawsuit is not allowed, they can give away your credit card details, without any real repercussion. Not lose, not let it be stolen, but give away. They are removing one of their very few incentives in keeping personal info safe and acting in the interest of the consumers.
