Los Angeles Superior Court Judge, Elihu Berle, has ruled that the lawsuit between publisher Activision and estranged Infinity Ward developers Jason West and Vince Zampella is to go ahead. Publisher EA has also been named as a defendant in the case by Activision.<\/p>\n
The judge said that there is sufficient evidence to support claims that Activision defrauded West and Zampella of money in the wake of the hugely successful Modern Warfare 2 launch. In March 2011, judge Berle ruled that Activision had sufficient claims against EA.<\/p>\n
Activision alleges breach of contract, insubordination and violation of company policy against the pair of developers. In the wake of their departure from Infinity Ward and Activision, West and Zampella formed Respawn Entertainment under the umbrella of EA. They also leeched a number of top developers from the Infinity Ward studio.<\/p>\n
West and Zampella are suing Activision for wrongful termination which they claim cost them more than US$125 million. Activision has launched a countersuit and dragged EA into the legal fray, accusing that publisher of scheming to lure West and Zampella way from Activision while they were under contract.<\/p>\n
Trial dates have yet to be set.<\/p>\n
