Duke Nukem developer 3D Realms is suing its former publisher, Gearbox Software, for unpaid royalties over Duke Nukem Forever.<\/p>\n

3D Realms has filed a breach of contract suit, claiming that Gearbox hasn\u2019t paid what it promised (more than $2 million) in the agreement which the both companies signed back in 2010.<\/p>\n

Gearbox issued a statement about the lawsuit from 3D Realms.<\/p>\n

\u201cIt\u2019s unfortunate that 3DR did not abide by the the objective audit rules outlined in the agreement and even more unfortunate that it chose to blame its failures on Gearbox. Since 3DR seems unable to accept reality and has chosen to become hostile, Gearbox is forced to bring its actual claims of breach of contract against 3DR and is confident Gearbox will prevail.<\/p>\n

\u201cPerhaps the lesson learned here is to never enter a gaming business deal with a person who has had more lawsuits than shipped games.\u201d<\/p>\n

3D Realms was originally developing Duke Nukem Forever, but Take-Two, who owned the publishing rights at the time, filed a lawsuit against 3D Realms after the developer failed to finish the game in time.<\/p>\n

Gearbox was then handed the reins to finish up the game and get it published, which it did in 2011 to a barrage of negative criticism despite making bucket loads of money.<\/p>\n
