Kyk net wat hulle demands is ons wonder net hoe eg hulle is

dis a pretty standard cease en desist brief. jy kan hulle vra om vir jou a copy van hulle klient se lisensie om die produkte te verkoop, maar ek so vir eers ophou om die produkte te verkoop want hulle het volle reg om jou te dagvaar as hulle wel die enigiste authorised re-seller is.

die Lanham Act waarna hulle verwys is 'n amerikaanse Act en dit lyk inelkgeval vir my of Section 32(1) te doen is met counterfit produkte wat veronderstel is om soos die oorspronlike te lyk maar is nie en 43(a)het te doen met die feit wie die reg het op die produk.

ek sou voorstel dat julle a prokureur gaan sien hieroor om julle korrkte advies te gee en om op die brief te antwoord.

die prokureur sal ook van jou kan se of die trade mark wel geregistreer is hierso en of hulle wel die sole supplier is in terme van die ooreenkoms met die verskaffer.

The basic premise is that any goods purchased or bought into the country without going through the "authorized dealers/resellers" are classified as grey/parallel imports.

The Consumer Protection Act requires grey goods to be clearly marked as such. A sticker or sign must indicate that the resellers are not the authorized distributors of the product, that they don't provide after-sales service and that the licensed distributors of the product in South Africa are not compelled to honor any warranties on the goods.

yea that is the one conclusion that was reached, The guys have decided to wait for contact from the main company in china. The irony is they claim its to cut down on fakes and clones, where in SA the people buy original Kangertech because its not that expensive but its a great quality.

It has also come to light that the guys who "own" KangerSA is a local company, that is charging the other companies to buy their rights to sell the stuff via them

A proper lawyer will sort out the legalities here, but if I recall correctly there is very little they can do if you mark your products as "Grey/Parallel Imports" unless they find a way to change SA law.

Oh the koppi envy is very real. Saw a bunch of photos on Facebook and Instagram of friends there. Wish I was there right now. There is still one koppi left in me, despite leaving my 20's and embracing my 30's, and I know The Dust is not kind to the old folks...

The friends who are there and making me jealous are 30-35, one has a kid, a couple are getting married soon (I think next weekend even?). Old is a state of mind. I need my finances to support going again, I'm over camping. Dust I can handle, but I want to not have to pitch a tent.
