Eish, but the fact remains that you cant go around distributing copyright material.

He's not. He's invoking the Fair Use clause - so his position is entirely fair, in my opinion. He's creating derivative works, which he is letting people use free of charge - thereby gaining no monetary benefit -if he had been selling the posters it would be another case entirely.

He had also posted a full disclaimer on the site assigning all rights and privileges to the holder of the rights (Bethseda in this case). As such, Bethseda had every right to ask him to take them down - that I have no argument with, but sending him a lawyer's letter? That's a dick-move of note.
 
Also, take note what they're saying,

"Please note that your use of the term Fallout, or any term confusingly similar to Fallout Marks"

In other words, they're going to start suing anyone who incorporates the word Fallout into any of their works. Don't you dare develop a game and think to name it Nuclear Fallout. Your ass is gonna get sued.
 
This is the whole "Scrolls" law suit all over again. I think Zenimax recently got a new lawyer whos a little over eager or something.
 
But seriously, if this keeps up I'm honestly not going to continue supporting Bethesda games, even if the developers are separate from the publishing house. I won't support someone who is going to continue bullying their way through their fanbase and the larger gaming community for no good reason.
 
This is what lawyers do. Remember that the programers for Skyrim paid homage to the Minecraft developer by putting in an item named after him. I don't think the heart of Bethesda would give a shit if someone was handing out wallpapers and stuff, but legal teams see it and immediately get massive erections.

I guess I'm a bit apathetic in this regard, I just want to play [insert game x here], I couldn't really care about all the politics and nonsense a studio gets up to for the most part.

Im the same, there is so much politics especially with publishers. Punishing the Developer for something the Publisher does hardly seems fair and unfortunately, for the time being anyways, the industry still needs Publishers.
 
Damn but that's dodgy of Bethesda. It's not like the guy is stealing their profits, or hurting their name. In fact he is giving their game free publicity. If anything, they should thank him.
 
Goodness this whole IP thing has really gotten to the point of stupid. This person is actually building the brand, creating a community, in the same way fan-art helps to make things popular. The legal system itself has gotten so convoluted it's really missed the whole point of its existence.

As for punishing the developers, that is pretty silly since they have no say in the decision whatsoever. Also the rate at which publishers do stupid crap and the rate at which people jump on the boycott train, soon no-one will be playing anything. :)

I wish people would stop using titles like this, its Bethesda's lawyers sending these letters out, half the time Bethesda don't even get notified before such things hit the news.

In that case, Bethesda's lawyers are giving them a bad rep. They should sue them for that
