That isn't a bad deal though.
 
Yeah it's a case of using the wrong logo. Description clearly states DS and the actual image also shows a DS, not a 3DS.
 
So if you troll them hard enough they may cave and give you something they don't want to? Doesn't sound very nice to me. "whistling:
 
The CPA states that if the discription of what you buy is correct but image not the Text is the item.
So you wont get much done.

Description is pretty vague & similar enough to that of the 3DS that you may yet succeed. Also the chances store assistant knowing the difference is minimal.

Then again you don't get a 3DS in white, only "cosmos black" and "aqua blue". The Cosmos black has a kind of shiny finish to it.
 
I see they changed their online ad.

I'm gonna go get the paper and go to them tomorrow, force them to give me a 3DS

Lol. This means they had to give someone a 3DS already. As these things normally dont change unless people start asking for the items that was mis-advertised.
 
So.. I tried Just1ce's tactic

I tried buying the 3DS over the weekend. The people said they had a small pamphlet with regards to the misprint. Tried to get the bastards to give it to me, but they refused. I threatend them with going to CPA, and they just glared at me. I have since laid a complaint with the ASA. This is their reply.

Dear Mr xxxxx

Thank you for your letter of complaint dated 15 June 2012.

To assist us in our investigation kindly forward us a copy of the advertisement.

Please note that the ASA does not have jurisdiction to force the advertiser to offer a refund or honour the advertised deal. We will, however, remove their advertising should we find that it contravenes the Code of Advertising Practice.

We look forward to hearing from you.
