That is ouch for her. But then again she has caused a lot of trouble for you guys . . .
yep and we found out she is kinda having an affair of sorts with an advocate... which the bosses do not know of although im sure they suspect

FUCK! I have a possible job interview Thursday afternoon and now I'm not allowed to take half day because I apparently have to give 2 weeks notice if I want time off

they don't give a shit. they'll want "proof of emergency". and if they find out I made it up to go for a job interview...

then I need a doctor's note. and they won't fall for it now

LOL,

- Can I have a half day leave on Thursday?
- No, you need to give us 2 weeks notice
- I feel a flu coming on, it'll probably be here by Thursday. Just a heads up

You can probably ask the interview people if you can reschedule for two weeks time and just tell them that you have to give two weeks notice to take time off at your current work. They will probably understand.

Is it a Monday or a Friday? Is it the day after a public holiday?

If not, fuck them. Basic Conditions of Employment Act stipulates that you may take up to two days consecutive sick leave without requiring a doctors note. For 3 or more, you need a note, and you may need a note for a sick day falling on the above days.

As you can tell, this attitude from employers severely annoys me.

Very good post Green, but he must just have a look at the HR policy to ensure that it's stipulated, the employer may have documented it differently.

My understanding, as a governance specialist, has always been that a company may not, in their policies, directly contravene any act or law of the country. Consequently, they may not contravene the Acts' stipulations regarding sick leave. My understanding is a bit more hazy regarding sick leave on a Monday, Friday or day after a public holiday, but there may be a clause in your employment contract specifically related to it.

Would be good to have one of our resident lawyers weigh in here. I don't have access to Juta to look up case precedent for that.

@Malice what does your company's code of conduct state?
apparently it's in the "company handbook"

yeah check your agreement, they must go F themselves.... 2 weeks notice to take an afternoon off? NEVER and the same for "calling in sick" in the middle of the week
yeah here you have to have a doctor's note doesn't matter when or how long you were off, otherwise they just take it from your annual leave.

they will be implementing 1 and 2 calendar month notice periods and restriction of trade clauses soon, so I need to GTFO before then

My company is very lax with regards to all that HR stuff. So I have no experience of the procedure.

Find another job ASAP. That is not somewhere you want to work, ever. After resigning, report them to the Dept. of Labour as contravening the BCEA.

Damn, you work for a ridiculously strict company. Odd though that they don't block sites like this on their network.

You can also ask the people if there's any chance that you can come in before 8 or after 5, or if the interview is quick and close enough, you can possibly squeeze it into your lunch hour.
