Regardless of whether or not they were smoking weed, he's approach to the situation, I think, was unwarranted. It's rather obvious that there were better ways of handling the situation. And according to a News24 article (http://www.news24.com/SouthAfrica/News/Fourways-bar-assault-Man-not-a-bouncer-20131004) he wasn't even a bouncer. I get that drugs are illegal, but can you imagine if people who are against drug-use went around beating up every drug user they came across? :confused:

ok so where is that cigarette butt now? i doubt that guy kept it... so how will the police prove this? they cant its as simple as that.

criminal law is very specific. you cannot charge someone with a crime on hearsay evidence. also what will the police charge them with possession of a cigarette that possibly has weed in it, based on video footage that is not clear?

The footage shows that he attacked them while they were busy smoking that cigarette. When he punched that guy, the guy nearest to the sink was still smoking it. He then dropped it, and Shane picked it up. If they were smoking weed, then it's evidence. If they do take him to court, he will definitely serve, but they on the other hand will pay a small fine and spend a few hours in jail. Still as I said, there is proof of them smoking weed :P .

I don't really want to get involved in this as I'm more of an observer in matters like this, but could you please explain to me how it's evidence of them smoking weed. I can see the guy smoking, but I definitely can't tell what he's smoking and I doubt that the Shane dude kept it so how exactly can he prove that they were smoking a joint?

this is exactly what i was trying to get him to explain but i think he is just arguing for the sake of arguing

The question here isn't if he kept the joint or not. The joint is there, he picked it up, and if it was marijuana he has proof.

Huh? That doens't prove anything dude. Just because you can see him smoking something does not automically mean he was smoking a joint. The only way it can be proven is if he (shane) kept the bud. It could be a rolled cigarette (with tabacco) or anything else.

Ummm as far as I know the cops must catch you in possession of the drug. Anyway this guy seems as if he had a nice excuse to use his muscles on smaller guys than him. I doubt he would have done anything if the people were his size or bigger. He is a knob.

exactly... possession is 9 tenths of the law.
like i said before hearsay evidence ie Shane saying they smoked a drug of some sort wont hold up in court cause it will be his word against theirs. the court will require physical evidence.
if you show this video to an impartial person and asked them what the guys were smoking they wouldnt be able to tell you cause the quality of the video is not very good. this video is only proof of an assault and perhaps a smoking law violation as these guys were smoking in the bathroom which im guessing is not an authorised smoking area.
 
Yeah the chances of the kids getting any sort of punishment for weed is remote, and it would be very light. I doubt the cops would try to prosecute. Shane on the other hand should get the full might of the law, and those kids should press charges. Its not ok to just go around punching okes for no real reason. That dude who hit his head on the sink easily could've died. Its that simple.
 
Some people just don't have much clue about the law regarding weed ........ It's hard to charge a dealer sitting with a pound of the shit ffs, you think anyone is gonna give any fucks at all about a joint that was maybe on a video and that some absolute smallballed chop may have kept a roach of? I have been in situations like these when the stance on weed was more hardcore than it is now and even then it was not a massive thing. And that was when they caught you with it, not days later.

Well yes, I don't know how shane assumed that they were smoking weed, but if he is correct then the cigarette is the proof that they were smoking weed. He handed the joint to another guy , which is presumably a real bouncer. He must have surely shown it to management because the 3 guys were banned from the club. We don't know any hard facts except that he beat the s**t out of them, the obvious thing to assume here is that the management kept the joint. There must have been a small investigation into this as one doesn't just let something like this slide.
