Are online store fronts anti-CPA?

SO here is my problem, it's all good and well that my digital purchase is refundable on Xbox One, provided I haven't started the download yet. But, when I purchase anything through the store, the download automatically starts, and I have to manually stop the download. This is a default setting of the Xbox, and I'm sure that it can be switched off, but it's a bit dodgy to do that and then claim I cannot be refunded because I already started a download that automatically I was forced to do by the default settings. It defeats the purpose a bit I think.
