It's not an issue anymore because only about 1 - 2 million of those people still play the game. Most of us have moved on.

Well I got tired of the lag spikes and gave up playing the start of last week. If they've done some improvements lately I didn't bother to check.

Not quite 10 million players, more like 10 million purchases.
I bet the number of people still playing isn't quite up to par with that count.
My entire gaming group doesn't play the game anymore, including me.
Snooze fest galore halfway through inferno.

I have to agree that diablo is quite addictive and lately the servers have been running very stable. However i'm about at the point where i'm getting bored with the game. Only so much item hunting you can do.
