Only a modded console can play pirated games. The console itself is banned from Xbox LIVE, not just the user account.

From what I've gathered is that you need a xbox live account to play xbox live games,but there is a monthly fee for the account,

There are two versions of XBox Live. The first one is free and just gives basic online services, like downloading free games and demos. I think you can also buy and download full games, but I'm not sure.

Then there is the XBox Live Gold version, which you have to pay for. You need it if you intend to play with friends and it gives extra online services, like Hulu, Netflix, etc if supported in your region. You also get a family pack version of Gold which works out cheaper per account.
