Is buying games second-hand "cheating"? THQ thinks so.

A very valid point unfortunately. Somehow though I doubt any publisher would ever really bother to enforce this as it would simply not be cost effective as they would be targeting private individuals and not companies, well mostly and they could sue you for loss of revenue etc, but how much could they honestly expect to gain from Joe Soap? Also, if I never play a game online, but only ever use it offline, those that support it, and then sell it 2nd hand to you, the publisher will have a very hard time proving that I owned it first.

But to answer the threads question, yes, I suppose it is cheating according the the agreements that are in place when you purchase the product. Now my question is this: Do you care that is technically cheating? My personal answer. No.
 
Now, I agree with you - the company only makes 1 sale, while 2 people plays it, but person B would not buy the game anyway, so they cannot bank on "potential profit". They should be thanking people for buying 2nd hand instead of pirating, because it's the trade of legitimate wares.
I agree with what you have said, just wanted to point out there, the person 2 is willing to spend money, for the game, even if its 2nd hand, thats more potential of a loss sale, then a pirate who would not want to spend, thats all.

I'm assuming again you refer to my killing someone analogy? Why is it stupid? Crass maybe, but that's the point. You can not justify a crime by saying well they were going do it, so why don't I do it first? That must be the dumbest argument ever. Tell you what, you try telling a court or the cops that should you ever be arrested for a crime and tell us how that works out for you.

Because I'm talking about something that has little harm to the dev/pub, death is final, and whats this with firsts? I'm simply stating a loss is a loss to the dev/pub
