I'm afraid to say that in this instance pirates are just as guilty. Anyone who has downloaded either of these has no excuse or defense.

Isn't it usually the people from QA that leak games? Why would an employee leak something they have been working their asses off for before it's realeased?

It doesn't really matter who leaks it. The person who downloads and plays it is just as bad as the one who leaks it.
