crashed into my car the other day:mad:
I was in a turning lane, She was behind me. Both of us wanted to turn right into a double lane. I waited for oncoming traffic to clear, and turned into the right sided lane.
The next moment she slams into my front right door:eek: . She thought she could turn as well:wtf:.
It's been a while since I did my licence, but I'm pretty sure you don't overtake someone while turning at a robot. You can obviously overtake as soon as you are out of the turn and know which lane the other car is taking. I keep wondering why she didn't hit her brakes, she must've seen me, I was IN FRONT of her the whole time:confused:
Anyways.
I got an accident report number and claimed from our insurance. Insurance phoned back today saying that they won't be claiming the pay-in amount from the girl because she says the accident is my fault and it will be too expensive for my insurance to find out what the truth is:mad::mad:

Moral of the story?
Stay away from Hatfield and its bloody students.
 
Don't think it would be hard to prove who was right and wrong in this case since she hit your side from behind so they just trying to weasel their way out of the payments.

Which insurance do you use so I can avoid them?

WTF insurance does she and you have? Kalipso Insurance? Sounds like a lame excuse to me. Cost too much to find out? Police have a report and it is obvious she was in the wrong.

Had a drunk driver crash through our face brick boundary wall, we did not lay charges, we just wanted the wall fixed. he claimed poverty to due to payment being too high to restore the wall. A week later was driving a new car. We had him handed over to insurance to pay the bill.

Insurance in this country is a joke.

Firstly - OP your description is dodgy as fck...took me 3 damn reads to understand who you're trying to get at. Said 3 reads being done...I do agree with you. If you roll with that in court you'll get massacred though.

Tell the insurance to fck off. Specifically try to pin down the fact that she started off behind you. If you can establish that then you're home free.

I'd start by asking her insurance for a detailed description of what happened. It'll be full of sht but chances are good that it starts with her behind you.

Also...I'd contact your insurance & tell them that its the opposing party is full of sht and your willing to fight it. (they get a thousand claims a day...they don't know when to put up a fight).

It's gonna cost you more to recover the excess than what your gonna get back, not worth it.

Agree with all.....don't accept that result. Insurance people will always try find a way to save money if you let them. If they dont wanna play ball, threaten with media exposure... They cant make that call as its part of law enforcements job to find out who was at fault not theirs. Logic dictates that if she was BEHIND you at a robot both turning same way its almost impossible for it to be your fault. Would also suggest changing your insurance...
My insurance doesn't claim a cent from me for excess..part of the package. Broker is also a decent idea...or use a very well know insurer.
 
You should tell the insurance company that they give bad service and threaten to leave them if they don't sort it out.
Don't just accept what they say.You pay every month for their service,which so far SUCKS.

In varsity I had an accident where a girl ran a stop street and I ploughed into her. She just didn't see me coming down the road and just went. I only had 3rd party cover at the time (R15k student car), and the fact that it was her fault as she had the stop street, I thought everything would work out. Later it came out we were both insured by the same company, hers was fully comp, mine was 3rd party. So the insurance said it was neither persons mistake, and we had to pay for our own repairs. Which meant I got nothing. It was the obvious choice for the insurance, they HAD to pay for her car being fully comp anyway, but mine was easy to get out of.
Fucking money hungry sacks of shit!

Tell your insurance to get of their arses, and do their jobs. You (and your insurance) shouldn't be liable in any way.

this is BS, escalate it with your insurance. also you could institute a claim for damages for the costs your insurance dont want to cover against her. but depending on the amount you might have to go the small claims court route (anything below R12000.00) this is however quite a time consuming process but if you know an attorney who can do you a favour to maybe send her a letter of demand, she might have a skrik and pay you otherwise said attorney friend could issue the summons for you at a reduced rate
 
Not at all the story I was expecting from the thread title.

Sounds like you were taking a nice wide turn and she thought you were turning into the left lane, and tried to turn into the right lane.

I would call it her fault, but insurance or police might say that it's joint liability.

Is it just the Excess that they are being funny about? There's no way they can not pay for your car.
