Would you help these people

Hi

Okay I recently dismissed 3 employees (via a hearing chaired by a 3rd party) for not pitching for work for 2 weeks, I pay them their outstanding salaries and get a fax last Wednesday from the CCMA stating that they are unfairly dismissed.

So this morning they pitch looking for their UI-19 (UIF/bloukaart) so I ask them why they took the case to the CCMA, their response was they have a right to do that. Which is fair, but they have zero chance of winning, but now they are inconveniencing me plus they want me to help them with the UI-19. I will give them the UI-19 as I do believe they are entitled to it (after an hour or two's wait) but what would you guys do, tell them to wait for the CCMA case or flat out refuse?

I'de give them their UI-19's and send them on their merry way, they don't deserve any help from you

Yeah I'm with Malice on this one. Once you've given them their documents, just chase them away. They are no longer your employees and they are not entitled to any help further from you. It's harsh, but it's life.

Update:

I filled in the UI-19 form and gave them a copy and asked them to check the ID numbers.

They come back 10 minutes later insisting I give them there proper UI-19, as I try and explain it is the proper form they start arguing, the one employee smells like he has been drinking, so I tell them they can take the form to the department of labour and find out if it is the correct document. They send the form back with the one guy who I was talking with earlier and he says the others want to hurt him if he takes the form.

So I told them now they can go to the department of labour and get the proper form and I'll fill it in again. The drunk one didn't like that so much and said I better answer my phone and said I neglect the black employees and who knows what else. . .

Be polite, give them the UI-19, and keep emotion out of it.

You don't want to give them any traction should the CCMA start to take their case seriously.

EDIT: Ah, I see you're beyond that already. Well, as long as you followed protocol, they ain't got nothing on you.

According to law if you dismiss employees you need to give them all the relevant paper work on dismissal date. So the right thing to do is just give them their stuff, I know it feels so wrong after getting so much lip from them but it is just better that way.

Like Dan said just give them the UI-19 and let them go, you've done your job and now all you can do is leave it to the CCMA to finish the rest of the case. The fact that one guy was already drinking means that there was little crap given about their working environment.

They will no doubt lose their case and are only interested in taking liberties of damaging a reputation of what sounds to be an amazing company to work for.

Not really the best company to work for, it just infuriates me when I have to trudge to the CCMA and the employees come as if nothing is wrong. . .

Will update you guys when they come back :D

Well when I say the best company, I mean that you guys look after your staff and probably recognize good work when you said that you pay them pretty well.

Anywho good luck with the case and let us know if we can advise further. :)

The best thing to do is to just handle this with care. Stay professional, wrap it up and put it behind you. It's probably not worth dealing with any unnecessary fallout afterwards that could have been prevented.

In all honesty you have a semi serious situation on your hands. Why do you come to an online forum for advice mate, you clearly dont know what you are doing after firing said people and it just makes me wonder really. Why come here and ask for advice when you should know what should happen before you act?

I think you should reread the OP. . .

I asked would you guys help them with the UI-19 form or tell them to wait till the CCMA case.
