Activision wins back modernwarfare3.com domain

Remember that story about the modernwarfare3.com URL redirecting visitors to Battlefield 3’s official site? Well, it won’t be doing that anymore.

Predictably enough, Activision didn’t think it was all that hilarious, and dropped a lawsuit on domain owner Anthony Abraham’s head. Also predictably enough, they’ve won.

The National Arbitration Forum has ruled unanimously in favour of Activision, citing three necessary criteria:

1.    The domain name registered by Abraham is identical or confusingly similar to a trademark or service mark in which Complainant has rights; and
2.    Abraham has no rights or legitimate interests in respect of the domain name; and
3.    The domain name has been registered and is being used in bad faith.

Abraham’s contending claim that the term “modern warfare” is generic did not go down quite as well as he’d expected. Maybe if the site hadn’t been covered in lame anti-Call of Duty rhetoric, he might’ve made a better point.

The panel has ordered that the domain be transferred over to Activision.
