problem is you can do anything with the hardware. but nothing to the software you dont own it. You only have a licence tp use the software. or this is how i understand what the problem is

That's pretty much it yes ... but the Terms & Conditions attached to the system when you buy it prohibit you from making any changes to either software or hardware. People may not like it, but it's Sony's prerogative to add them, and honestly - no-one makes people buy the system.

And frankly, the moment you open the box, unpack and switch on the system, you agree to those terms and conditions - and whining and complaining after it is a bit silly in my book. Also, Sony is far from the only company to do this - it's pretty standard.

Yes, I'm also aware that MS allows tinkering with the XBox - so people can feel free to buy that and tinker with it if that is what takes their fancy.

We do have bigger issues. But does that mean that while the SAPS focus on bigger issues, these okes can run rampant? I don't think so.

Perhaps you should look at the Broken Windows campaign run in New York many years ago. The bigger issues as you put it, were not the focus.
 
I just find it so funny how almost everyone here carry's on about the PS3 being jailbroken etc, but no one ever mentions the Xbox 360's shortcoming when it comes to piracy. It is just as pirated, if not more then the PS3, yet no one wants to talk about it. Why is that?

It has been mentioned. The cops should be klapping anything pirated with a vengeance. Set up a anti-piracy unit (if there isn't one already, so that the rest of the cops can go on with the other crimes) and get this crap off of our streets.

He got busted while in possession of a pirated games and possession of games used as originals for pirating. And seriously - thinking it's okay just because no-one is being harmed?

Here's a little theoretical question for you. If you walk into a store and walk out with say, a chocolate, without paying - no one got harmed, right? And, I mean, it's only a couple of rands. Not going to cost people their jobs. The store loses maybe R2 or R3.

So, using your logic, it's okay. Since no-one gets harmed. I mean ... screw the law.

You can not be serious? So we can let off people who commit "lesser" crimes? You do know that many hardcore criminals started off with "lesser" crimes and progressed to more serious crimes, eventually becoming killers, rapists etc? Granted, your average hacker isn't likely to turn into the next Ted Bundy, but then again, who knows? Look at all those nuts who went apeshit and shot up schools and island resorts? Do you really want to be the guy who said, nah, let him go, only for that person to later become the next Columbine shooter?

Crime is crime and should be punished. Klaar. End of discussion. Whether or not you believe it is a crime doesn't factor, because it is the law of the country that counts, not your opinion. If we let this guy off the hook, where do we draw the line between which crimes are okay and which aren't? And, who gets to decide where that line is?
 
I am against piracy for comercial gain and have tried to inform the cops about that guy at Bright Water Commons, who chips PS3s and Xboxes and sells the pirated games, so cool.

But, piracy is piracy and crime is crime. Are you telling me that non of you have some movies or series that you have downloaded from sites such as the piratebay? "pirate" being the opperative word. Or just taken some from a friend? Or is all your music legally obtained too? I don't think so. This too is piracy. So is there a line somewhere where it is okay if you are on the one side? or must we all stop downloading movies/series and wait for 6 months for them to come out in South Africa on DSTV (which some of us don't have) or even better, wait 3 years for it to come out on SABC? I believe there is a line.

While I don't actively support piracy, I think there is no way to stop it in todays information sharing world. We should just rid the world of the scum performing piracy for comercial gain. Such as the guy at Bright Water Commons.

While I am happy to see the cops doing something other than harrasing innocents, I do think their resources could have been better spent. I know the theory of "start with the small crimes to eliminate the bad" but really. This sounds like it was a big job and used many valuable resources and money. If they want to start with the small, start with the littering. Fine people for littering. All it takes is one cop to see it. But the cops are doing it.

YEah.. i dont think the jailbreak is the main issue. but pirating stuff for personal gain is a bit hectic; he must be connected to other criminal activity.

Yup. If you make money that rightfully should have gone to someone else, that's stealing. Hobomincer has a point too. There are multiple views regarding piracy. The main "criminal" one being making money from something that rightfully belongs to someone else. I still think having pirated stuff is not right, heh. I own all of my stuff legally. Sometimes I'll download something, just to give it a listen/watch. If I like it, I'll buy it. If not, I'll discard it.

Playing Devils Advocate here, you do relies SA Jail is is School for criminals, with subjects in rape, murder, theft, hijacking etc...

This guy will very likely end up with a suspended sentence and a heavy fine - not to mention a permanent criminal record.

Sadly ... most of our criminal justice and corrective services system qualify for the label "dismal failure" - regardless, broken laws still need to be punished.

Well, +1 to you for actually buying all your stuff and so on. I just can't stand having DVD's taking up good bookshelf space. 1 small hard drive is good for me.

You know what would be a good idea? I think anyway... Is if you went to a shop with a flash drive and could purchase movies that they would just stick on your flashdrive for you. Saving you time, bandwidth and space (on your bookshelf) also the price could be cheaper as you wouldn't pay for all the packaging etc. Everyone (the artists, distributors, producers etc.) could still get their rightful pay and royalties, and (in our present day global village) we could get the movies and series when they come out. Just like the rest of the world does, instead of waiting for up to a year.

Technically piracy is not theft. Theft removes the original. When you pirate, the original is still intact. So your analogy is flawed. Let me demonstrate it to you with a picture.
