If that happens, there goes BF3, Sony was off-line for a month, that will kill EA, hahaGet ready for anonymous to threaten with all hell and thunder fury to compromise and/or crash their servers.
Or at the very least deliver 1000 pizzas to the ceo's house.

I don't think it'll happen. Mostly because A) even if it is unconstitutional, it acts as deterrent, B) I don't think proving so in court would be completely trivial and inexpensive, and C) they'll keep it that way for where it's not unconstitutional.
That said, I'd love to see them try and defend this in court someday. Someday soon, hopefully.
