EA climbs aboard the “YOU CAN’T SUE US LOL” terms of service lollercoaster

Lol another company forcing you to sign your rights away. It's pretty amusing that companies are jumping on the band wagon. I mean really, do they get that many lawsuits thrown into their laps that this can be justified or are they planning something that is going to peeve off a lot of customers and cause them to sue them for everything they have?

Or at the very least deliver 1000 pizzas to the ceo's house.

I've already sold my PS3 and all related games, accessories, etc. Really EA? This is the route you prefer? Instead of actually not screwing up, you would rather tell your customers to go get f***ked?

Well to be honest this really doesn't bug me. I'm going to sue EA for what reason, for releasing an awful game, don't quite get it.:confused:

To the kindly gentleman who neg-repped me for this post, and stated the following as reason,

No, not really. The fact that the only reason you neg-repped me is because it's BF3 aside, it sparks an interesting discussion. Just because these companies are all trying to get away with murder doesn't mean we should sit down and just accept it. I'm surprised this is even allowed in the first place. The right to sue a company cannot simply be waived by ticking a box just because the company doesn't like being sued.

If that happens, there goes BF3, Sony was off-line for a month, that will kill EA, haha

I don't think it'll happen. Mostly because A) even if it is unconstitutional, it acts as deterrent, B) I don't think proving so in court would be completely trivial and inexpensive, and C) they'll keep it that way for where it's not unconstitutional.

That said, I'd love to see them try and defend this in court someday. Someday soon, hopefully.

EA is full of shit lately anyway. Like that Origin privacy policy that takes all your privacy rights away.
 
These terms are not enforce able in SA so need to worry (but then again how likely are South Africans to sue EA given the costs of litigation).
 
I'm not sure what you would be able to sue for to begin with. The clause is probably aimed at Americans since they like to sue for anything they can think of and the clause is there to try and prevent them from thinking along the lines of EA.

Unless the clause is with regards to Origin when personal information gets leaked and you become a victim of a crime because of that (e.g. credit card details leaked), but then I doubt that the agreement will hold much water anyway.

That's exactly what this is all about. Also: If they change their mind and sell all your details you can't sue them for breach of contract - even though they promised they would never sell the details, you now have no recourse.

It is not unconstitutional. You have no "right to sue" by the constitution in any country on Earth. This clause in the agreement does and will hold. If, like mentioned above, EA sells everybody's personal info - there can't be a class action lawsuit. Nothing. You're f***ked. Go sit down and cry in the corner.
 
And so? Why would I want to sue ea? I mean it would take years to see anything happen.
 
Well as I read the term and I'm not a legal person so I could be wrong. As stated by wiki:
In law, a class action or a representative action is a form of lawsuit in which a large group of people collectively bring a claim to court and/or in which a class of defendants is being sued.
So this means you can't sue them as a part of a class action but you can still sue them in your personal capacity.
So the only thing this clause actually does is to make it harder to sue them as it's going to be harder and more expensive to sue them as an individual than in a group.
