BT Games Second-hand Games policy

I have just bought a second-hand game from BT Games recently and to my surprise, they would not allow me to buy the game without me giving them my personal details. I have bought games from them several times and never had this issue.... in fact, they do not request that I give them my information when buying a new game.

So, according to them, they have this new second-hand game policy where the "police" require it of them so ensure that stolen goods aren't sold and whatnot. I have yet to see this system being implemented anywhere else.

Now, I would perfectly understand if they request this from a seller of the game, as they do not know where it came from, but me as a customer, I am going and legitimately buying a game from them (a legitimate store whom should ensure that they are not selling me stolen goods). I doubt that is illegal. Why do they need my information?

I doubt I will be buying many more second-hand games in future.

What are your thoughts on this?

I dont have a problem with it myself. I think Cash Crusaders etc. do the same thing if Im not mistake.
Though I hear what you're saying, some people I know do not give out addresses etc. at all.

Not when you buy.

@OP I think once you're set up on the system, you don't have to go through it again.
I'm more annoyed with their rental policy, where you have to give them bank statements and all that crap.

EDIT: I assume the purpose is that if it does end up being stolen, they know where to track down the last known buyer.

It's the second hand goods act. Look it up, Act 6, 2009, Chapter 4. Page 20 of the 2009 Goverment Gazette if I'm not mistaken. I can upload you a scan a bit later if you want?

I have no idea why they only started implementing this recently. Maybe the police or someone really did get on their case, but it is the law.

I was also surprised and asked them why, but they explained about the legal requirement.

If they just wanted it for fun; that would be another story.

Been like that at our BTgames stores here for a while already, nothing new really.

Yeah when I wanted to buy a 2de hand game from them they also asked me for fking everything from proof of resident. So walked out and have not since gone back to buy anything from them.

Yo do realise that they are legally required to get this info when you buy a second hand game, right?

Ok. Now you know. Read my first post in this thread for more info ...

Says nothing of have to have my proof of residents.

Surely you mean residence? And yes they need it. Not necessarily proof of residence, but they do require your physical address. Proof of residence is only required when you open a rental account if I'm not mistaken.

I think I'll take a break after class monday and check the corresponding legislation at the library. Hopefully the real quote from the actual legislation should stop everyone crying about BT games.

No need. :) (The important bit is underlined.)

Thus not supplying the correct deals, under subsection 4, is a breach and by extension a criminal act itself, so give them your details correctly.
Under subsection 5, BT games needs a copy of your I'd also.
There it is in black and white, if you don't give details when buying 2nd hand goods then you go to jail, don't pass begin, no R200.

Thanks Wlad, saved me the hassle of finding this.
btw this act is very easy to read, wish SARS could write like that

That does clear things up a bit, but what I do not understand is that only BT Games has it implemented at this stage, and if it's been the law since 2009, then why is it only implemented now? Not to mention that I only saw this at BT Games thus far.

I am still unsure as to why they need the details of the buyer though. But the law is the law I guess.

2009 was when they wrote the act, it often goes through rewriting before it is actually enacted which accounts for the delay.
The new companies act was written in 2008 but the first time they started really using and teaching it was like 2011. Same issue here, act written in 2009 but they need time for it to circulate and be studied before it becomes practice. Its kinda confusing at times. Check for as amended date for practical enactment.

Hmm.... makes sense... so I guess that over the next few months we should expect to see this implemented at other places too.
What would have been nice though is if this portion of the act was posted somewhere in the store where the customers could read it and understand why the new system is being implemented.
