Bethesda Softworks, responsible for the Fallout franchise, has announced that it is suing Interplay for trademark infringement.
In 2006 Interplay signed an agreement with Bethesda to develop a Fallout MMO game. Subsequently a report was filed stating that the game would require $5.75 million to develop and it was agreed upon that Interplay would have licence to the rights attached to the game if it began full scale production within 24 months.
Bethesda are now alleging that Interplay did not uphold its agreement to begin production on what is commonly referred to as Project V13 by the 4th of April and that the company has not secured the required funding.
Interplay denies this and upholds that it still has the right to develop Project V13 with Bulgarian based Masthead Studios.
Because legal conjecture may prevent a swift decision being made regarding licensing issues it would be reasonable to assume that Fallout Project V13 will not be released in the foreseeable future, if at all.
